These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you") and XORB ("we," "our," or "us") governing your access to and use of the XORB mobile application and any related services (collectively, the "Service"). By downloading, installing, or using XORB, you confirm that you are at least 13 years of age (or 16 in the EU) and that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

Your access to and use of XORB is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and any others who access or use the Service. These Terms should be read in conjunction with our Privacy Policy, which is incorporated herein by reference.

2. Entertainment & Educational Use Only

XORB provides high-precision astrological modeling, natal chart analysis, transit forecasting, and relationship synastry tools for entertainment, educational, and self-reflection purposes only.

XORB IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL, PSYCHOLOGICAL, PSYCHIATRIC, LEGAL, FINANCIAL, OR ANY OTHER LICENSED PROFESSIONAL ADVICE. The astrological insights provided by XORB represent one interpretive system among many and do not constitute predictions of future events.

Any decisions you make based on content generated by the application are made solely at your own risk. XORB expressly disclaims any liability arising from reliance on astrological content for real-world decisions.

3. Account, Eligibility & Platform Stewardship

You must be at least 13 years old to use XORB (16 years old if you are located in the European Union). By using XORB, you represent and warrant that you meet this age requirement.

You may authenticate via Apple Sign-In or Google Sign-In to enable cloud backup and cross-device sync. You are responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized access at support@x-orb.com.

XORB operates a "Local-First" stewardship model. Birth data and astrological profiles are encrypted and stored on your device and synchronized via platform-native cloud services (iCloud / Google Drive). You retain full ownership of the data you input into the application.

4. Subscriptions, Payments & Cancellations

4.1 Premium Subscription
XORB offers a "Premium" subscription that unlocks advanced features including the proprietary transit analysis engine, advanced synastry module, and 120-day energy forecasting. Access to Premium requires a paid subscription billed on a monthly or annual basis.

4.2 Free Trial
Where offered, a free trial period grants temporary access to Premium features at no charge. At the end of the trial period, your subscription will automatically convert to a paid subscription unless you cancel at least 24 hours before the trial expires.

4.3 Billing & Auto-Renewal
Payments are processed exclusively through the Apple App Store or Google Play Store. Your subscription will automatically renew at the end of each billing period unless auto-renewal is disabled at least 24 hours before the renewal date.

4.4 Cancellation
You may cancel your subscription at any time through your Apple ID Settings (iOS) or Google Play Account Settings (Android). Cancellation takes effect at the end of the current paid period. Access to Premium features continues until the period end date.

4.5 Refunds
All purchases are final and non-refundable, except as required by applicable law or as determined by Apple or Google pursuant to their respective refund policies. Refund requests for App Store purchases must be submitted directly to Apple via reportaproblem.apple.com. XORB has no ability to issue refunds directly for platform-processed payments.

4.6 Restore Purchases
A "Restore Purchases" function is available within the application settings to allow you to re-activate an existing active subscription on a new device. This feature does not create new entitlements.

5. Proprietary Engine & Intellectual Property

XORB and all of its content, features, and functionality — including but not limited to the proprietary Gaussian Orb weighting system, Placidus-iterative house calculation engine, VSOP87D planetary position module, ELP2000-82 lunar module, all software, algorithms, design, text, graphics, logos, and interfaces — are and will remain the exclusive property of XORB and are protected by copyright, trademark, and other applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use XORB solely for your personal, non-commercial purposes in accordance with these Terms. You may not copy, modify, distribute, sell, sublicense, decompile, reverse-engineer, or create derivative works of any part of the application without our explicit prior written consent.

6. User Conduct & Prohibited Actions

You agree not to:
• Use XORB for any unlawful, fraudulent, or harmful purpose
• Attempt to bypass, circumvent, or disable any paywall, license check, or subscription verification mechanism
• Use automated scripts, bots, or scrapers against the application
• Upload or transmit viruses or any other malicious code
• Attempt to reverse-engineer, decompile, or extract the source code of the calculation engine
• Interfere with or disrupt the integrity or performance of the Service
• Impersonate any person or entity or misrepresent your affiliation

Violation of these prohibitions may result in immediate termination of your access without refund.

7. Disclaimers & Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, XORB IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL XORB, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO XORB IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) USD $10.

8. Indemnification

You agree to defend, indemnify, and hold harmless XORB and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party rights.

9. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We will not be liable to you or any third party for any such modification, suspension, or discontinuation.

10. Modifications to These Terms

We reserve the right to update or modify these Terms at any time. Material changes will be communicated through an in-app notification. The "Last Updated" date at the top of this page reflects the most recent revision. Your continued use of XORB following any changes constitutes your acceptance of the revised Terms.

11. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately. All provisions of these Terms which by their nature should survive termination shall survive — including intellectual property, disclaimers, indemnification, and limitations of liability.

12. Dispute Resolution

We encourage you to contact us first at support@x-orb.com to resolve any concerns informally. Most issues can be resolved quickly through direct communication.

If a dispute cannot be resolved informally within 30 days, any legal claim arising out of or relating to these Terms or the Service shall be subject to binding individual arbitration administered in accordance with the applicable laws of the Republic of Serbia. YOU AGREE TO RESOLVE DISPUTES INDIVIDUALLY AND WAIVE ANY RIGHT TO A CLASS ACTION OR CLASS-WIDE ARBITRATION.

13. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Serbia, without regard to its conflict of law provisions. Any disputes that are not subject to arbitration shall be subject to the exclusive jurisdiction of the competent courts located in Belgrade, Serbia. If you are an EU consumer, you may also have the right to bring proceedings before the courts of your country of residence.

14. Force Majeure

XORB shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, terrorism, riots, network infrastructure failures, cybersecurity incidents, or strikes.

15. Severability

If any provision of these Terms is held by a court or arbitrator of competent jurisdiction to be invalid, illegal, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or severed from these Terms if modification is not possible. The remaining provisions of the Terms will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire and exclusive agreement between you and XORB regarding the Service and supersede all prior agreements, representations, or understandings — whether written or oral — relating to the subject matter herein.
